Employment law, from the company’s side of the table

Lynch Laboral is a practice focused on Peruvian employment law for companies. We work for the people who make decisions about people: general managers, CFOs, administration and HR, as well as regional headquarters and investors overseeing Peruvian operations.

Our approach

An employment decision is never just a legal act. It affects cost, timing, morale, vendor relationships and sometimes the value of the business. So we start every matter with how the operation works, not with the statute.

We would rather prevent than litigate. Most employment exposure in Peru starts with routine decisions (a fixed-term contract renewed without review, a roster redesigned without recalculating averages, a contractor who ends up taking orders) that would have been cheap to fix in time.

When exposure already exists (an inspection, serious misconduct, a complex exit), we act with method: evidence first, deadlines under control and every decision documented.

Good employment advice is measured not by the opinion it gives, but by the decision it makes possible.

Prevention, judgment, response and control

  1. Prevention

Audits, obligation matrices and compliance calendars to find exposure before it has a deadline.

  2. Judgment

We read the law with the business case on the table, always separating what the statute says, what the authority tends to require and what we recommend.

  3. Response

Inspections, disciplinary procedures and exits handled with deadlines under control and evidence in order.

  4. Control

Every significant decision is documented: what was decided, on what information and why.

Method

  1. Understand the operation

Structure, shifts, contract types, providers and decision-makers.

  2. Review the documents

Contracts, records, payroll, policies and correspondence, checked against the applicable Peruvian rules.

  3. Size the exposure

Concrete, prioritized scenarios your finance team and regional HQ can assess.

  4. See it through

Drafting, review and follow-up until the decision is closed.

Built to work with operations and finance

Payroll literacy

Much employment exposure shows up in payroll first: unpaid overtime, misclassified pay items, benefits calculated on the wrong base. We read payroll as a legal document and coordinate with Lynch Payroll when monthly processing is part of the solution.

Financial and corporate perspective

We translate employment risk into terms a CFO, a parent company or an investment committee can use: estimated exposure, priority, and the cost of fixing versus the cost of waiting.

English and Spanish

We report directly to headquarters, regional management and foreign law firms that need to understand the Peruvian framework without an intermediate translation.

Institutional relationship with Lynch

Lynch Laboral is a specialist practice institutionally affiliated with Lynch Contadores & Abogados, a Peruvian accounting and law firm. The relationship brings institutional backing and an integrated reading of each decision (employment, accounting, tax and financial), while Lynch Laboral keeps its own focus, its own working team and its own editorial approach.

Lynch Payroll runs the monthly payroll. Lynch Laboral advises on the decisions behind it.

What we do not do

  • We do not act for employees in claims against employers.
  • We do not promise outcomes in proceedings or inspections.
  • We do not give opinions without reviewing the relevant documents.
